Water Damage in a Rental Apartment in Germany: What to Do

Published on March 5, 2026

What Should I Do First After Water Damage?

Water damage in a rental apartment requires quick action. First, shut off the water supply if possible, and document the damage with photos and videos. Notify your landlord immediately – preferably in writing. In Germany, prompt written notification is not just good practice: tenants have a legal duty to report defects without delay, and failing to do so can cost you money later.

Who Pays for Water Damage in a German Rental?

The question of costs depends on the cause:

  • Burst pipe or structural defects: The landlord bears the costs for repair and remediation of consequential damage
  • Tenant’s defective washing machine: The tenant is liable for the damage; their personal liability insurance (Haftpflichtversicherung – a very common and inexpensive insurance in Germany) usually covers the costs
  • Damage caused by neighbors: The neighbor or their liability insurance is responsible

Can I Reduce My Rent for Water Damage in Germany?

Yes. As long as the water damage has not been repaired and limits your living quality, you are entitled to a Mietminderung (rent reduction) under § 536 BGB, the relevant provision of the BGB (German Civil Code). The reduction applies automatically by law – you do not need the landlord’s permission. The amount depends on the extent of the impairment:

  • Damp walls in one room: approx. 5–15%
  • Drying equipment in use: approx. 20–30% (due to noise and restrictions)
  • Room unusable: up to 50%

Why You Must Send a Written Defect Notice First

Without a written defect notice (Mängelanzeige) to the landlord, you may not reduce your rent. Set a reasonable deadline for remediation – typically 14 days. Keep in mind that letters to German landlords should be written in German; an English email is easy for a landlord or property manager to ignore. If your landlord refuses to act, a local Mieterverein (tenant association – a membership organization offering affordable legal advice to tenants) can support you in a dispute.

Tip: Keep all receipts – photos, correspondence, and invoices. These can be decisive in case of a dispute.
